A jury found appellant Howard R. Craig, Sr. guilty of Child Molesting, Ind. Code § 35-42-4-3(a), a Class B felony, and Incest, I.C. § 35-46-1-3, a Class D felony, by having sexual contact with his son. Craig received sentences of ten years for the Child Molesting offense, and one and one-half years for the Incest offense, with the sentences to be served concurrently. The Court of Appeals affirmed the Child Molesting conviction, but ordered the Incest conviction vacated, because the underlying proof of both offenses was that of the same single sexual act. Craig v. State (1993), Ind. App., 613 N.E.2d 501. Craig petitions for transfer. Transfer is granted.
